These Terms & Services (“Terms”) govern your access to and use of the website merrifieldob-gyn.com (the “Site”), including educational content about women’s health, obstetrics, and gynecology, appointment request forms, newsletter tools, and the client-side care-plan cart. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
Merrifield OB-GYN (“Merrifield,” “we,” “us”) provides information and request pathways for obstetrics and gynecology services offered to patients in the United States. These Terms are a website-use agreement. They are not a substitute for a clinical informed-consent discussion, an insurance contract, or emergency medical care.
The Site is an informational and administrative portal. Articles, service descriptions, clinician biographies, pricing tables, pregnancy timelines, and nutrition tips are general educational materials about women’s health. They are not medical advice for your specific condition, pregnancy, or gynecologic history. Only a licensed clinician who has evaluated you can diagnose, treat, or recommend a plan of care.
Nothing on the Site creates a physician–patient relationship solely by browsing, submitting a form, adding a care plan to the cart, or subscribing to email. A clinical relationship begins only after Merrifield accepts you as a patient through its operational processes and applicable professional standards.
Obstetrics and gynecology involve inherent clinical uncertainty. Outcomes of pregnancy, birth, surgery, medication, or conservative care cannot be guaranteed. Testimonials reflect individual experiences and are not promises of similar results.
The Site is not an emergency service and is not monitored in real time for crisis messages. If you think you may be experiencing a medical emergency—including but not limited to severe bleeding in pregnancy, chest pain, difficulty breathing, thoughts of self-harm, seizure, or sudden severe abdominal pain—seek emergency care immediately through local emergency services. Do not use website forms for time-critical symptoms.
Postpartum mood changes can be serious. If you or someone you love is in immediate danger, contact local emergency services or a crisis resource in your community.
The Site is intended for adults in the United States who are seeking information about obstetrics, gynecology, and related women’s health services. You represent that you are at least 18 years of age, or that you are a parent or legal guardian using the Site on behalf of a minor in a manner permitted by law. You are responsible for complying with the laws of the state from which you access the Site.
We do not publish street addresses or telephone numbers on the Site. Scheduling and follow-up occur through the channels we confirm after you submit a request.
Forms on the Site (appointment, contact, subscribe, unsubscribe) require accurate information. You agree not to impersonate another person or submit false clinical histories. Submitting a form is a request, not a confirmed visit. Merrifield may accept, decline, or reschedule requests based on clinical appropriateness, capacity, and professional judgment.
You authorize us to contact you at the email address you provide regarding scheduling, educational newsletters (if you opt in), and administrative messages related to your request. You may unsubscribe from marketing newsletters as described on the Unsubscribe Email page. Transactional messages about a request you initiated may still be sent as needed to complete that request.
Client-side validation on forms helps reduce incomplete submissions. It does not guarantee that a request has been received until you see an on-screen confirmation message.
The Price page allows you to place named care plans (for example Basic, Standard, or Advanced) into a cart stored in your browser. The cart is client-side only. No payment card is processed on the Site. Checking out does not charge your account, does not create an insurance claim, and does not enroll you in a plan until a Merrifield representative contacts you and you complete any required agreements.
When you check out, the Site displays a message substantially as follows: “Your order processed, one of our representatives will contact you.” That message confirms that your browser recorded a checkout action. It is not a guarantee of plan availability, pricing, or clinical eligibility. Plan features described on the Site are illustrations of bundled obstetric and gynecologic support and may be adjusted after clinical review.
Prices shown are monthly illustrative figures for educational display. They are not a binding offer. Insurance benefits, deductibles, and self-pay arrangements are discussed after contact, not through the public cart.
Blog posts, FAQs, nutrition lists, pregnancy-month illustrations, and service copy are provided “as is.” Women’s health science evolves. Screening intervals, vaccine recommendations, and obstetric protocols change. We strive for accuracy aligned with contemporary United States professional guidance, but we do not warrant that every page is complete, current, or applicable to you.
To the fullest extent permitted by law, Merrifield disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement regarding the Site. We do not warrant uninterrupted or error-free access, or that the Site is free of harmful code. You are responsible for using updated browsers and reasonable security practices.
The Merrifield OB-GYN name, floral emblem logo, layout, original text, and original graphics on the Site are owned by Merrifield or used under license. You may view pages for personal, non-commercial use. You may not copy, scrape, resell, or republish substantial portions of the Site, including care-plan language and clinician biographies, without prior written permission.
Photographs used on the Site are sourced from licensed natural image libraries or created for Merrifield. They are illustrative of women’s health, pregnancy, and family life and do not depict a specific identified patient unless expressly stated. Do not assume that any photograph is of a particular clinician or patient.
You agree not to misuse the Site, including by: attempting to probe or disrupt servers; submitting malware; harvesting emails; posting defamatory or unlawful content in any field; using automated tools to overload forms; or using the Site to provide clinical advice to others as if you were Merrifield.
We may suspend access if we reasonably believe these Terms have been violated or if continued use could harm patients, staff, or the integrity of the Site.
Footer social icons may link to third-party platforms. Those services have their own terms and privacy practices. Merrifield is not responsible for content or data practices on platforms we do not control. Sharing a page from the Site is your choice; do not share another person’s health information.
To the fullest extent permitted by applicable United States law, Merrifield and its clinicians, staff, and contractors shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the Site, inability to use the Site, reliance on educational content, or delay in responding to a non-emergency form. Our aggregate liability arising from website use shall not exceed one hundred United States dollars, except where such limitation is prohibited (including certain liability for gross negligence or willful misconduct where the law does not allow a waiver).
Some states do not allow certain limitations. In those states, our liability is limited to the maximum extent permitted.
You agree to indemnify and hold harmless Merrifield from claims arising out of your misuse of the Site, your violation of these Terms, or your submission of information that infringes another person’s rights, except to the extent a claim is caused by Merrifield’s willful misconduct.
Personal information submitted through the Site is described in our Privacy Policy, which is incorporated by reference. Please read it carefully, especially if you share reproductive or pregnancy-related details in a message. We encourage you to share only what is needed to route your request.
We may update these Terms as services, technology, or law change. The “Last updated” date will change when we do. Continued use of the Site after an update constitutes acceptance of the revised Terms. Material changes to how we handle newsletter consent will be described on the Subscribe and Unsubscribe pages as well.
These Terms are governed by the laws of the United States and the state in which Merrifield principally administers its website operations, without regard to conflict-of-law rules, except that clinical care, when provided, is governed by the professional and facility rules applicable to that care. Exclusive venue for disputes arising from website use (not clinical malpractice claims, which follow applicable healthcare law) shall be in competent courts in that state, unless a consumer protection statute requires otherwise.
If a provision of these Terms is held unenforceable, the remaining provisions continue in effect. These Terms, together with the Privacy Policy and any additional notices on a specific form, are the entire agreement regarding website use and supersede prior website terms.
